1. Acceptance of Terms
By accessing or using HelixaCare (“the Platform”), operated by HelixaCare Health Technologies Private Limited, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Platform.
These Terms are governed by the laws of the Republic of India, including but not limited to the Indian Contract Act 1872, the Information Technology Act 2000, the Consumer Protection Act 2019, and the Digital Personal Data Protection Act 2023.
2. Eligibility
- You must be at least 18 years of age to create an account
- Parents or legal guardians may create and manage accounts on behalf of minors (under 18) as family members, in compliance with Section 9 of the DPDP Act
- You must be a resident of India or have a valid Indian medical report to use the platform
3. Description of Service
HelixaCare provides:
- A secure platform to upload, store, and organise medical lab reports
- Automated extraction and digitisation of health metrics from lab reports
- Health trend visualisation and analytics
- Activity and diet tracking for personal health management
- Family member health data management

Always consult a qualified registered medical practitioner (RMP) for medical decisions. Health metrics, trends, and advisories shown on the Platform are for informational purposes only and should not be used as a substitute for professional medical consultation.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to provide accurate and complete information during registration
- You must immediately notify us of any unauthorised use of your account
- One person may hold only one account. Multiple accounts may be terminated
5. Acceptable Use
You agree not to:
- Upload fraudulent, forged, or manipulated medical reports
- Use the Platform for any unlawful purpose or in violation of Indian law
- Attempt to reverse-engineer, hack, or compromise the Platform's security
- Use automated bots, scrapers, or crawlers to access the Platform
- Impersonate another person or misrepresent your identity
- Upload content that infringes intellectual property rights of any third party
- Use the Platform to store data unrelated to health and medical records
6. Health Data and Reports
6.1 Accuracy
While we use advanced OCR and AI technology to extract data from your lab reports, automated extraction may contain errors. You are responsible for verifying the accuracy of extracted health metrics against your original reports. HelixaCare is not liable for any decisions made based on incorrectly extracted data.
6.2 Report processing
When you upload a lab report, it is processed through secure automated systems to extract health metrics. The original report file and extracted data are stored securely in compliance with IT Act 2000 security standards.
6.3 Unit standardisation
Health metrics may be automatically converted to standardised units (following Indian NABL laboratory conventions) for consistent trend tracking. Original values from your reports are preserved for reference.
7. Intellectual Property
- The Platform, its design, code, and content are the intellectual property of HelixaCare Health Technologies Private Limited
- Your health data belongs to you. We claim no ownership over your personal health information
- You grant us a limited licence to process your data solely for providing the Platform services
8. Pricing and Payments
HelixaCare is currently offered free of charge for individual patients. We reserve the right to introduce paid features or subscription plans in the future, with at least 30 days advance notice. Any paid services will comply with the Consumer Protection (E-Commerce) Rules 2020.
9. Limitation of Liability
To the maximum extent permitted by Indian law:
- HelixaCare is provided on an “as is” and “as available” basis
- We do not warrant that the Platform will be uninterrupted, error-free, or completely secure
- We are not liable for any health outcomes resulting from use of the Platform
- We are not liable for errors in automated data extraction from lab reports
- Our total liability shall not exceed the amount paid by you (if any) in the 12 months preceding the claim
Nothing in these Terms excludes liability for fraud, wilful misconduct, or any liability that cannot be excluded under Indian law.
10. Indemnification
You agree to indemnify and hold harmless HelixaCare Health Technologies Private Limited, its directors, employees, and agents from any claims, losses, or damages arising from your violation of these Terms or misuse of the Platform.
11. Account Termination
- You may delete your account at any time from Account Settings
- Upon deletion, your data will be permanently erased as per our Privacy Policy retention schedule
- We may suspend or terminate your account if you violate these Terms, with notice where practicable
12. Dispute Resolution
- Grievance redressal: Contact us at support@helixacare.com. We will acknowledge within 24 hours and resolve within 30 days
- Mediation: If unresolved, disputes will be referred to mediation under the Mediation Act 2023
- Arbitration: Failing mediation, disputes will be settled by arbitration under the Arbitration and Conciliation Act 1996, with the seat of arbitration in India
- Jurisdiction: The courts of India shall have exclusive jurisdiction over any matters arising from these Terms
13. Consumer Rights
As a consumer under the Consumer Protection Act 2019, you have the right to:
- File a complaint with the appropriate Consumer Disputes Redressal Commission
- Seek redressal through the National Consumer Helpline (NCH) at 1800-11-4000
- Access the e-Daakhil portal (edaakhil.nic.in) for online consumer complaint filing
14. IT Act 2000 Compliance
In accordance with the Information Technology Act 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021:
- We have appointed a Grievance Officer whose details are available in our Privacy Policy
- We implement reasonable security practices as defined under Section 43A of the IT Act
- We follow due diligence requirements for intermediaries under Section 79
15. Modifications to Terms
We may modify these Terms from time to time. Material changes will be communicated via email or in-app notification at least 15 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction in India, the remaining provisions shall continue in full force and effect.
